Luigi D'Agostino

Luigi D'Agostino is the founding member and principal attorney of D'Agostino & Company, P.C. He possesses 30 years of construction experience and more than a decade of experience as a litigator and counselor to developers, owners, contractors, subcontractors, material suppliers, sureties, and other construction professionals. Mr. D'Agostino understands the industry's issues.

Mr. D'Agostino resolves construction related disputes, in court, arbitration, mediation or any other dispute resolution forum. He resolves delay claims, mechanic's lien and bond claims, contract default, equitable adjustment, termination, design defect, and other construction and matters. Mr. D'Agostino's experience includes the representation of lenders, developers, owners, contractors, subcontractors, material suppliers, design/builders, and sureties.

He counsels and advises clients on emerging issues, evolving case law, and legislation that affect their business, to keep them ahead of the curve on exposures and opportunities.  His industry experience includes positions with both local and national construction contractors, construction managers and developers. Before forming D'Agostino & Company, P.C., Mr. D'Agostino was a litigator with a boutique construction law firm, quickly rose to serve as General Counsel for a private owner / developer / construction manager in the tri-state area, and went on to counsel one of the largest construction companies in New York City. He was employed by a family owned development / construction company for twenty years, and served in various corporate and field positions, including accounting, project accounting, estimating, scheduling, risk management, field superintendent, and litigation and claims manager.

His practice focuses on construction law, and counsels lenders, investors, general contractors, subcontractors, suppliers, construction managers, developers, and owners on contract negotiations, risk management and disputes.   He serves a wide range of the construction industry, and represents lenders, investors, prime and general contractors, subcontractors, owners, developers, construction managers, subcontractors, equipment and material suppliers, architects / engineers and other design professionals, and sureties in matters ranging from project planning to dispute resolution. He resolves claims involving breach of contract, construction and design defects, mechanic's liens, delays and schedule impacts, payment and performance bonds, and insurance issues concerning the building and construction industry.
